We, Frep AI (“we”, “us”, “our”, “Frep AI”, “Company”) are the owners and developers of Frep AI mobile application (referred to as “Application” or “App”). The Application is designed to simplify and personalize the process of meal planning and to support your discipline, consistency, and personal meal planning goals. The Application enables you to input dietary preferences, dietary restrictions, allergies, ingredient availability, consumption behavior, family size, and other relevant information. Based on your inputs, the Application uses an AI system (artificial intelligence-based technology) to generate personalized meal recommendations, provide recipe suggestions, macro estimation, pantry tracking, shopping/grocery suggestions, and other related outputs (“Services”).

We respect data privacy rights and are committed to protecting Personal Data collected on the Application. This Privacy Notice (“Privacy Notice”) sets forth how we collect, use, and protect the personal data collected through the Application.

YOU HEREBY AGREE AND PROVIDE CONSENT TO THE COMPANY FOR PROCESSING YOUR PERSONAL DATA FOR THE PURPOSES SET OUT IN THIS PRIVACY NOTICE. SUCH AN INTIMATION TO WITHDRAW YOUR CONSENT CAN BE PROVIDED BY EMAIL ON PRIVACY@FREP.AI.

IF YOU ARE ACCESSING THE APPLICATION ON BEHALF OF A THIRD PARTY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH THIRD PARTY TO THE TERMS AND CONDITIONS OF THIS PRIVACY NOTICE AND, IN SUCH AN EVENT, YOUR USE OF THE APPLICATION SHALL REFER TO USE BY SUCH THIRD PARTY. IF YOU DO NOT HAVE SUCH AN AUTHORITY (TO PROVIDE PERSONAL DATA OF A THIRD PARTY) OR DO NOT AGREE TO THE TERMS OF THIS PRIVACY NOTICE, THEN YOU SHOULD REFRAIN FROM USING THE APPLICATION.

This Privacy Notice is an electronic record in the form of an electronic document and is construed in accordance with the applicable data protection laws.

  1. Definitions
    • “Personal Data” means any data about an individual who is identifiable by or in relation to such data.
    • “User/s”, “you”, “your” shall mean and include individuals who visit, access and/ or use the Application and subscribe/ purchase Services offerings.
  2. Personal Data Collected

    We may receive your Personal Data in the following ways:

    • Enquiries/ Contact Us: When you enquire about our service offerings and our Application, we may receive your Personal Data including but not limited to name, phone number, email address.
    • Through the Application: When you sign up on our Application, create an account, create a profile and avail our service offerings, we may receive your Personal Data, which may include but not be limited to full name, contact number, email address, location, gender, age, photographs profession dietary preferences, dietary restrictions, allergies, eating habits, and size of the family.
    • Online Identifiers and system data: When you use our Application, we may receive information about your system usage, device type, browser type, usage duration, system logs, IP address, app event data, diagnostics, crash logs, and push-notification tokens, etc.
    • Social Media Platforms: If you engage/ interact with us through our social media handles such as Meta, X, LinkedIn etc., we may receive your Personal Data including but not limited to your social media handles, full name, any information you share via direct messages other details about your profile, or any other information with us.
    • Social Logins/Third-Party Sign-Ins: If you choose to register or log in to our Application using a third-party account (such as Google, Apple, or similar services), we may receive and share such Personal Data for facilitating the Application.
    • Payment and Transaction Data: We do not collect, store, or process any financial information such as bank account details, net banking credentials, debit or credit card numbers, or other payment instrument data. All payments are processed directly by authorized third-party payment service providers. We only receive payment status and transaction confirmation information from such third parties for record-keeping and service-fulfilment purposes.

    For clarity, the key categories of Personal Data and the specific purposes for which they are processed are set out below:

  3. Accuracy

    The User undertakes that he/she shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Data shared with us, whether their own or any third party. In the event the User is sharing any Personal Data on behalf of a third party, the User represents and warrants that he/she has the necessary authority to share such Personal Data with us and that we may process such Personal Data in accordance with this Privacy Notice.

  4. Purpose

    We may use your Personal Data in the following ways:

    • To create and manage your account;
    • To offer Services.
    • To connect you with relevant service providers;
    • to recommend relevant services/products;
    • To use User preferences to provide personalized meal lists and recommend relevant services/products;
    • To improve Application functionality and user experience;
    • To send transactional messages (For ex. OTP etc.);
    • To send important updates, offers, or newsletters;
    • To ensure compliance with applicable laws and our legal and contractual obligations.
  5. Cookies

    We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns. Tracking tools are also used are beacons, tags and scripts to collect and track information and to improve and analyze our Application. You may choose to disable cookies through your Application settings.

  6. Anonymised Data

    We may also use your Personal Data collected to create aggregate anonymized data. While we will continue retaining such derived or anonymised data, any Personal Data will be deleted. We shall ensure that such anonymized data will not be directly identifiable to you or to the Personal Data shared with us. We may use this anonymized data for any purpose including but not limited to conducting research, analytical purposes, and improving our Application. By using the Application, you provide us the right to use your Personal Data to create anonymized data and use it for our business purposes.

  7. Disclosures

    We do not sell, rent, share, distribute, lease or otherwise provide your Personal Data to third parties, without your prior consent. Keeping this in mind, we may disclose your Personal Data in the following cases:

    • Affiliates: We may provide your Personal Data to our affiliates to enable them to improve the Application, provide feedback and respond to their queries.
    • Service Providers: We may share your Personal Data with the service providers who work with us in connection with operating the Application and/or providing the Services. All such service providers are subject to stringent confidentiality restrictions consistent with this Privacy Notice.
    • Merger or Acquisition: We may transfer your Personal Data if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the Application, to a third party. Any third party or resultant entity that receives your Personal Data shall have the right to continue to use your Personal Data in line with the purposes set out herein.
    • Safety, Legal and Regulatory Authorities: We may disclose your Personal Data if we believe that we are required to do so: (a) by law; (b) to comply with legal process or governmental requests; (c) to enforce our agreements; (d) to protect our operations; (d) to protect the rights, privacy, safety or property of Frep AI, you or others; (e) to protect our reputation and (f) to permit us to pursue available remedies or limit the damages that we may sustain.
  8. Privacy Rights

    In accordance with applicable data protection laws, you have the following rights in respect of your Personal Data:

    • Right to access/ review Personal Data in our possession,
    • Right to have us rectify, erase/delete or modify any such Personal Data,
    • Right to raise grievance with our Grievance Redressal Officer,
    • Right to nominate,

    Depending on the nature of the request, we may ask you to complete a Personal Data request form or seek certain details to verify the request. All requests for Personal Data will be handled within a reasonable period of time. If you would like to exercise ANY of these rights, please contact privacy@frep.ai.

    Without prejudice to the above, in the event your grievance is not addressed within the prescribed timelines or to your satisfaction, you may approach the Data Protection Board of India, in accordance with the procedure prescribed under applicable law.

  9. Data Retention

    We will retain the User’s Personal Data as long as it is required to be retained for the provision of the Application. We may also retain and use Users’ Personal Data as necessary to comply with our legal obligations, resolve disputes, enforce our agreements and as per applicable law.

  10. Your Choices And Opt-Out

    We may send you communications, including but not limited to (a) notices about your use of the Application, including those concerning violations of use, (b) updates, (c) promotional information regarding our Application, and (d) newsletters. You may opt out of receiving promotional emails and newsletters from us by following the unsubscribe instructions provided in those emails. Alternatively, you can opt out at any time by emailing us at privacy@frep.ai with your specific request.

  11. Third Party Websites, Applications and Pages

    Our Application may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third-party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your Personal Data. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

  12. Security Practices

    Users' Personal Data is stored on third-party cloud servers. Although the Company implements reasonable security safeguards to protect Users' Personal Data against loss, unauthorized access, processing, or disclosure. These measures include appropriate firewalls, access controls, and encryption protections, the Company cannot warrant the security of any Personal Data transmitted as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, the Company disclaims liability to the extent permitted under applicable law.

  13. Children’s Personal Data

    Our Application is not meant for use by any person who is under the age of 18 years. If you believe we might have any information from or about a child, please contact us at privacy@frep.ai.

  14. Governing Laws And Disputes

    This Privacy Notice shall be construed and governed by the laws of India and shall be subject to the exclusive jurisdiction of the competent courts in Pune, India.

  15. Cross Border Transfer

    In the course of the Company’s business operations, Users’ Personal Data may be transferred to, stored, or otherwise processed on servers located outside India, including servers operated by the Company or its third-party cloud service providers. The Company ensures that any such transfers is in accordance with applicable data protection laws.

  16. Updates

    We reserve the right to update this Privacy Notice at any time. The updated Privacy Notice will be made available through our Application along with the date of the latest revision. If such modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change via email or through the Application.
